These terms are the agreement between you and the developer: what the app gives you, what you shouldn't do with it, and who is responsible for what. How your information is handled is covered separately in the Privacy Policy.

1. Accepting these terms

Creating an account, or ticking "I have read and agree", means you accept these terms. If you don't accept them, you can still use the app fully without an account — you just won't have cloud sync.

You must be at least 13. If you're under 18, please use the app with your guardian's knowledge and consent.

2. What the app is

Record Everything is a local-first journaling app: your stamps, notes and papers live on your device by default. Creating an account enables optional cloud sync so your records follow you across devices. Sync is optional, not a condition of use.

3. Your account

• Use an email address you can actually receive mail at — password recovery depends on it, and there is no other way in.
• You are responsible for keeping your password safe. Activity under your account is treated as yours.
• Tell us if you think someone else is using your account.
• You can delete your account at any time. Deleting removes both the cloud copy and the records on that device, permanently. To switch accounts instead, use Sign out.

4. Gull coins

Gull coins are an in-app virtual item used to unlock stamps and papers. Specifically:

• They are not money, have no real-world value, and cannot be cashed out, transferred, or exchanged for anything outside the app.
• They are earned through check-ins, tasks, achievements and redemption codes. The current version does not sell them.
• What you unlock with them is a licence to use that content in the app, not ownership of it.
• Coins or content obtained by modifying the app, forging requests, or abusing redemption codes may be revoked, and the account suspended.
• If the app shuts down, unused coins are not refunded. We would announce it in advance and keep export working.

5. Membership subscription

Record Everything is free to use. Membership is an optional auto-renewing subscription that unlocks some extra features.

• Plans and price: monthly and yearly. The price shown in the app is authoritative — currency and tax differ by country or region, and the actual amount is displayed and charged by the App Store on iPhone, or by Google Play on Android.
• Auto-renewal: your subscription renews and is charged within 24 hours before the end of the current period, unless you cancel before then.
• How to cancel: on iPhone, in Settings › Apple Account › Subscriptions. On Android, open the Google Play app › your profile picture › Payments and subscriptions › Subscriptions. Deleting your account in the app, or deleting the app, does not cancel the subscription — you have to cancel it there.
• After cancelling: you keep access until the end of the period you already paid for; nothing is cut off immediately.
• Refunds: subscriptions are billed by Apple or by Google, so refunds are handled by whichever one charged you. Please request one through the App Store or through Google Play — I cannot issue refunds directly.

Please read this part carefully — it describes what happens when membership ends:

• Member-only stamps: use them freely while your membership is active, at no coin cost. When the subscription ends you can no longer stamp new ones, but every mark you already placed in your notebook stays — nothing is deleted or blanked out.
• Gull coins earned during membership (the monthly allowance and the doubled check-in rewards) remain yours after it ends.
• The member badge and stickers stop showing once the subscription ends.
• Papers you created beyond the free limit are kept, but creating new ones after the subscription ends is subject to the free limit again.

I may adjust what membership includes — usually by adding to it. If I ever remove a benefit already promised or raise the price, I will announce it in the app beforehand, and a price increase additionally requires your consent through the App Store or Google Play: without it, your subscription will not renew at the new price.

6. Your content is yours

You own what you create in the app. To make sync work, you grant permission to store, transmit and back up that content as needed to provide the service — nothing more. We don't browse, publish, sell, or use it for training or advertising. See the Privacy Policy.

You are responsible for what you record. Don't use the app to store unlawful content, or content you don't have the rights to.

7. The app itself is mine

The previous section is about the content you record. This one is about the app — they are different things:

• The software, interface design, stamp and paper artwork, copy, name and logo of Record Everything are owned by me, or licensed to me by their respective rights holders.
• What you get is a revocable, non-exclusive, non-transferable licence to use the app on devices you own or control, on the terms set out here. Nothing else is transferred.
• Please don't copy, adapt or redistribute the artwork in the app, or use it commercially. Marks you stamp yourself are of course yours to share.
• Open-source components used in the app remain under their own licences; you can request the notices at the email address below.

8. Things you shouldn't do

• Reverse-engineer or modify the app, or bypass any in-app limits;
• Automate account creation, or farm coins and rewards;
• Attack or stress the servers, or otherwise interfere with other people's use;
• Resell accounts or redemption codes, or use in-app content commercially;
• Upload unlawful, infringing, or malicious content.

Accounts doing these things may be limited or terminated.

9. How the service is provided

The app is provided "as is". Features may be added, changed or removed over time, and sync may occasionally be interrupted for maintenance or reasons outside our control.

Stamping, writing and browsing your records all work offline and never need an account, so an outage does not lock you out of what you have already recorded. Sync and cloud backup do require signing in.

You can export a copy of everything at any time via Me → Export data. Keeping your own backup is the surest protection against losing anything.

10. Disclaimers and limits

To the extent permitted by law, we are not liable for: service outages caused by force majeure, network failures or third-party providers; data loss caused by your own actions (such as deleting your account); or losses caused by failing to keep your account secure.

To the maximum extent permitted by law, our total liability to you will not exceed what you actually paid for the app in the preceding twelve months. Nothing here excludes liability that cannot be excluded by law.

11. Changes and termination

Features may change. If the service is discontinued entirely, we will give at least 30 days' notice in the app and on this page, and keep export available during that time. You may stop using the app, or delete your account, at any time.

12. Changes to these terms

If these terms change, the date at the top of this page is updated. Material changes to your rights or obligations will be flagged prominently in the app. Continuing to use the app after a change means accepting it.

13. About the store you installed from

The same app ships on the App Store and on Google Play, and the two stores ask different things of me. Only the block matching where you got the app applies to you.

If you installed from the Apple App Store

These are Apple's requirements for a custom end-user licence agreement, and they are also simply true:

• This agreement is between you and Record Everything, not between you and Apple. Record Everything, not Apple, is solely responsible for the app and its content.
• The licence granted to you is a non-transferable licence to use the app on any Apple-branded device that you own or control, and as permitted by the Usage Rules in the App Store Terms of Service.
• Maintenance and support are entirely my responsibility. Apple has no obligation whatsoever to furnish any maintenance or support services.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• I, not Apple, am responsible for addressing any product liability claims, regulatory compliance issues, consumer protection claims, and third-party claims that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• The app may use third-party services; your use of them is also subject to the relevant third-party terms.
• Apple and its subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance Apple has the right to enforce this agreement against you as a third-party beneficiary.
• Questions, complaints or claims relating to the app should be directed to me at zimo_2000@icloud.com.

If you installed from Google Play

Google does not impose a template the way Apple does, so this is shorter. The substance is the same:

• This agreement is between you and Record Everything, not between you and Google. Google is not a party to it, and is not responsible for the app or its content.
• The licence granted to you is a non-transferable licence to use the app on any Android device that you own or control.
• Maintenance and support are entirely my responsibility. Google has no obligation to provide them.
• Your use of Google Play is additionally governed by the Google Play Terms of Service. Subscriptions are charged by Google, and refunds follow Google Play's refund policy.
• The app may use third-party services; your use of them is also subject to the relevant third-party terms.
• Questions, complaints or claims relating to the app should be directed to me at zimo_2000@icloud.com.

14. General

• Severability: if any provision is held invalid or unenforceable, the rest remains in effect.
• Entire agreement: this agreement, together with the Privacy Policy, is the whole agreement between us about the app and replaces any earlier discussions.
• No waiver: not enforcing a right straight away doesn't mean giving it up.
• Assignment: you may not assign your rights or obligations. I may assign this agreement in connection with a reorganisation, merger or sale, with notice in the app, and without reducing the commitments already made to you.

15. Governing law and contact

This agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, excluding conflict-of-law rules. We will try to resolve any dispute amicably first; failing that, it goes to the courts of competent jurisdiction in British Columbia.

This does not take away mandatory rights your local law gives you. If consumer protection law where you live grants you rights that cannot be contracted away — such as the right to bring proceedings in your local courts — those rights still stand and this section does not affect them.

一、这份协议怎么生效

你注册账号、或者勾选「我已阅读并同意」，就表示你接受这份协议。不接受的话，可以不注册——戳戳！不登录也能完整使用，只是没有云端同步。

你需要年满 13 周岁。未满 18 周岁的，请在监护人知情同意后使用。

二、这个应用是什么

戳戳！是一个本地优先的记录应用：你盖的章、写的备注、做的纸样，默认只存在你自己的设备上。

注册账号之后可以开启云端同步，让这些内容跟着账号走、换设备不丢。同步是可选的，不是使用这个应用的前提。

三、账号

• 请用你自己能收信的邮箱注册。收不到确认信就用不了找回密码，那时候没有别的办法帮你进去。
• 账号和密码由你自己保管。用你的账号做出来的事，视为你做的。
• 发现账号被别人用了，尽快改密码并联系我。
• 你可以随时注销。注销会同时删掉云端和这台设备上的记录，不可恢复——只是想换个账号的话，用「退出登录」。

四、鸥币

鸥币是应用内的虚拟道具，用来兑换印章、纸样这些装饰性内容。关于它，有几件事需要说清楚：

• 鸥币不是货币，没有现实价值，不能提现、不能转让、不能兑换成钱或任何应用之外的东西。
• 鸥币通过签到、完成任务、成就、兑换码等方式获得。当前版本不出售鸥币。
• 用鸥币换来的内容，是在这个应用里使用的许可，不是所有权。
• 发现有人通过修改客户端、伪造请求、滥用兑换码等方式刷取鸥币，我可以撤销相应的鸥币和内容，必要时停用账号。
• 应用停止运营时，未使用的鸥币不作补偿。真到那一天，我会提前公告，并保证你能把自己的记录导出带走。

五、会员订阅

戳戳！本身免费。会员是可选的自动续订订阅，开通之后能用一些额外功能。

• 档位与价格：分「月会员」和「年会员」两档，价格以你在应用内看到的为准——各国家和地区的币种、税率不同，实际扣款金额在 iPhone 上由 App Store 显示并结算，在安卓上由 Google Play 显示并结算。
• 自动续订：订阅会在当前周期结束前 24 小时内自动续订并扣费，除非你在那之前取消。
• 怎么取消：iPhone 上在「设置 › Apple 账户 › 订阅」里管理或取消；安卓上打开 Google Play 应用，点右上角头像 →「付款和订阅」→「订阅」。在应用内删除账号、或者卸载应用，都不会自动取消订阅，得去那里操作。
• 取消之后：已经付过费的那个周期可以用到结束，不会立即中断。
• 退款：订阅由 Apple 或 Google 收款，谁收的款就由谁处理退款，请通过 App Store 或 Google Play 申请，我这边无法直接为你退款。

会员权益到期之后会怎样，这一条请特别留意：

• 会员专属印章：会员期间可以随便用，不消耗鸥币；订阅到期后不能再盖新的，但你已经盖在本子上的印记会一直保留，不会被删除或变成空白。
• 会员期间获得的鸥币（每月津贴、签到双倍的那部分）到期后仍然归你，不会被收回。
• 会员标识和贴纸在订阅到期后不再显示。
• 会员期间超出免费额度做的纸样会保留，但到期后要再新建，仍然受免费额度限制。

会员权益的具体内容我可能会调整（多数情况下是增加）。如果要减少已经承诺的权益或者涨价，我会提前在应用内公告，涨价还会由 App Store 或 Google Play 单独征求你的同意——不同意的话订阅不会按新价格续订。

六、你记的东西归你

你在戳戳！里创作和记录的内容（印记、备注、纸样、封面等）所有权是你的。

为了把同步这件事做成，你授权我在提供服务所必需的范围内存储、传输、备份这些内容。这个授权仅限于此：我不会浏览、公开、转让或用它们做训练、广告。具体见隐私政策。

你要为自己记录的内容负责。请不要用它存放违法内容，或者别人享有权利而你没有获得授权的内容。

七、这个应用归我

上一条说的是你记的内容。这一条说的是应用本身——两者要分开：

• 戳戳！的软件、界面设计、图章与纸样的美术素材、文案、名称和标识，著作权和其他知识产权归我所有，或由相应权利人授权给我使用。
• 你获得的是一项可撤销、非独占、不可转让的许可，用来在你自己拥有或控制的设备上、按本协议使用这个应用。除此之外没有转让任何权利。
• 请不要复制、改编、二次分发应用内的美术素材，也不要把它们用于商业用途。自己盖出来的印记当然可以随便发。
• 应用中使用的开源组件，遵循其各自的开源许可证；相关声明可通过文末邮箱索取。

八、请不要做这些事

• 反编译、破解、修改客户端，或绕过应用内的任何限制；
• 用自动化手段批量注册账号、刷取鸥币或任务奖励；
• 对服务端发起攻击、压力测试或任何影响他人正常使用的行为；
• 转卖账号、兑换码，或把应用内内容用于商业用途；
• 上传违法、侵权或含有恶意代码的内容。

发生上述情况，我可以限制或终止相应账号的服务。

九、服务怎么提供

戳戳！按「现状」提供。随着版本更新：

• 功能可能增加、调整或下线，界面也可能变；
• 云端同步可能因维护或不可抗力临时中断。

盖章、写本子、翻回顾都不需要登录，也不需要联网——东西就在你手机上，服务中断不会把你已经记下的内容锁住。需要登录的只有同步和云端备份。

随时可以用「我的 → 导出数据」把全部内容导出来。自己留一份备份，是最稳妥的保险。

十、免责与责任限制

在法律允许的范围内，戳戳！不对以下情况承担责任：因不可抗力、网络故障、第三方服务中断造成的服务不可用；因你自己的操作（如误删、注销账号）造成的数据丢失；因你未妥善保管账号造成的损失。

在法律允许的最大范围内，我对你承担的赔偿责任总额，不超过你在过去十二个月内为本应用实际支付的金额。

本条不排除法律规定不可排除的责任。

十一、服务的变更与终止

我可能会调整或停止部分功能。如果要整体停止运营，我会在应用内和这个页面上提前至少 30 天公告，并在这段时间里保证导出功能可用。

你也可以随时停止使用，或注销账号。

十二、协议的变更

这份协议如有修改，会更新页面顶部的日期。涉及你权利义务的重要变更，会在应用内显著提示。变更后继续使用，视为接受新版本。

十三、关于你从哪个商店装的

同一个应用同时上架 App Store 和 Google Play，两家对我的要求不一样。下面两块，只有和你安装来源对应的那一块对你生效。

如果你是从 Apple App Store 安装的

这些是 Apple 对自定义用户协议的要求，也确实是实情：

• 本协议是「戳戳！」和你之间的约定，不是你和 Apple 之间的约定。应用的内容由「戳戳！」负责，与 Apple 无关。
• 我授予你的，是一项在你拥有或控制的 Apple 品牌设备上使用本应用的、非转让的许可，并须遵守 App Store 的《使用条款》中的「使用规则」。
• 维护与支持完全由我负责，Apple 没有任何提供维护或支持的义务。
• 如果应用不符合任何适用的保证，你可以通知 Apple，Apple 会将购买价款退给你（若有）。在法律允许的最大范围内，除此之外 Apple 不承担任何与本应用有关的保证义务。
• 与本应用有关的产品责任主张、法律法规合规问题、消费者保护主张，以及第三方提出的知识产权侵权主张，由我负责处理，Apple 不负责。
• 你声明你不在美国政府实施禁运或被其认定为「支持恐怖主义」的国家或地区，也不在美国政府的任何禁止或受限名单上。
• 本应用可能使用第三方服务，你使用时须同时遵守相应第三方的条款。
• Apple 及其子公司是本协议的第三方受益人，在你接受本协议后，Apple 有权作为第三方受益人对你强制执行本协议。
• 与本应用有关的问题、投诉或权利主张，请联系我：zimo_2000@icloud.com。

如果你是从 Google Play 安装的

Google 没有像 Apple 那样规定模板，所以这一块短一些，意思是一样的：

• 本协议是「戳戳！」和你之间的约定，不是你和 Google 之间的约定。Google 不是本协议的一方，也不对应用及其内容负责。
• 我授予你的，是一项在你拥有或控制的安卓设备上使用本应用的、非转让的许可。
• 维护与支持完全由我负责，Google 没有提供维护或支持的义务。
• 你使用 Google Play 还须遵守 Google Play 服务条款。订阅由 Google 收款，退款按 Google Play 的退款政策处理。
• 本应用可能使用第三方服务，你使用时须同时遵守相应第三方的条款。
• 与本应用有关的问题、投诉或权利主张，请联系我：zimo_2000@icloud.com。

十四、其他约定

• 可分割性：本协议某一条被认定为无效或不可执行的，不影响其余条款继续有效。
• 完整协议：本协议连同隐私政策，构成你我之间就本应用达成的完整约定，取代此前的口头或书面沟通。
• 不弃权：我没有立即行使某项权利，不代表放弃该项权利。
• 转让：你不得转让本协议下的权利义务。我可以在业务重组、合并或转让的情况下将本协议转让给继受方，但会提前在应用内告知，并且不会因此降低对你已作出的承诺。

十五、适用法律与联系方式

本协议适用加拿大不列颠哥伦比亚省及适用于该省的加拿大联邦法律，不含其冲突法规则。因本协议产生的争议，双方应先友好协商；协商不成的，提交 不列颠哥伦比亚省有管辖权的法院解决。

这一条不剥夺你所在地法律给你的强制性权利。如果你所在国家或地区的消费者保护法赋予你不可通过约定排除的权利（例如在本地法院起诉的权利），那些权利仍然有效，本条不影响它们。

在法律允許的範圍內，戳戳！不對以下情況承擔責任：因不可抗力、網路故障、第三方服務中斷造成的服務不可用；因你自己的操作（如誤刪、刪除帳號）造成的資料丟失；因你未妥善保管帳號造成的損失。

在法律允許的最大範圍內，我對你承擔的賠償責任總額，不超過你在過去十二個月內為本應用實際支付的金額。

本條不排除法律規定不可排除的責任。

十一、服務的變更與終止

我可能會調整或停止部分功能。如果要整體停止運營，我會在應用內和這個頁面上提前至少 30 天公告，並在這段時間裡保證匯出功能可用。

你也可以隨時停止使用，或刪除帳號。

十二、協議的變更

這份協議如有修改，會更新頁面頂部的日期。涉及你權利義務的重要變更，會在應用內顯著提示。變更後繼續使用，視為接受新版本。

十三、關於你從哪個商店安裝的

同一個應用同時上架 App Store 和 Google Play，兩家對我的要求不一樣。下面兩塊，只有和你安裝來源對應的那一塊對你生效。

如果你是從 Apple App Store 安裝的

這些是 Apple 對自定義使用條款的要求，也確實是實情：

• 本協議是「戳戳！」和你之間的約定，不是你和 Apple 之間的約定。應用的內容由「戳戳！」負責，與 Apple 無關。
• 我授予你的，是一項在你擁有或控制的 Apple 品牌裝置上使用本應用的、非轉讓的許可，並須遵守 App Store 的《使用條款》中的「使用規則」。
• 維護與支援完全由我負責，Apple 沒有任何提供維護或支援的義務。
• 如果應用不符合任何適用的保證，你可以通知 Apple，Apple 會將購買價款退給你（若有）。在法律允許的最大範圍內，除此之外 Apple 不承擔任何與本應用有關的保證義務。
• 與本應用有關的產品責任主張、法律法規合規問題、消費者保護主張，以及第三方提出的智慧財產權侵權主張，由我負責處理，Apple 不負責。
• 你宣告你不在美國政府實施禁運或被其認定為「支援恐怖主義」的國家或地區，也不在美國政府的任何禁止或受限名單上。
• 本應用可能使用第三方服務，你使用時須同時遵守相應第三方的條款。
• Apple 及其子公司是本協議的第三方受益人，在你接受本協議後，Apple 有權作為第三方受益人對你強制執行本協議。
• 與本應用有關的問題、投訴或權利主張，請聯絡我：zimo_2000@icloud.com。

如果你是從 Google Play 安裝的

Google 沒有像 Apple 那樣規定範本，所以這一塊短一些，意思是一樣的：

• 本協議是「戳戳！」和你之間的約定，不是你和 Google 之間的約定。Google 不是本協議的一方，也不對應用及其內容負責。
• 我授予你的，是一項在你擁有或控制的安卓裝置上使用本應用的、不可轉讓的授權。
• 維護與支援完全由我負責，Google 沒有提供維護或支援的義務。
• 你使用 Google Play 還須遵守 Google Play 服務條款。訂閱由 Google 收款，退款依 Google Play 的退款政策處理。
• 本應用可能使用第三方服務，你使用時須同時遵守相應第三方的條款。
• 與本應用有關的問題、投訴或權利主張，請聯絡我：zimo_2000@icloud.com。

十四、其他約定

• 可分割性：本協議某一條被認定為無效或不可執行的，不影響其餘條款繼續有效。
• 完整協議：本協議連同隱私權政策，構成你我之間就本應用達成的完整約定，取代此前的口頭或書面溝通。
• 不棄權：我沒有立即行使某項權利，不代表放棄該項權利。
• 轉讓：你不得轉讓本協議下的權利義務。我可以在業務重組、合併或轉讓的情況下將本協議轉讓給繼受方，但會提前在應用內告知，並且不會因此降低對你已作出的承諾。

十五、適用法律與聯絡方式

本協議適用加拿大不列顛哥倫比亞省及適用於該省的加拿大聯邦法律，不含其衝突法規則。因本協議產生的爭議，雙方應先友好協商；協商不成的，提交 不列顛哥倫比亞省有管轄權的法院解決。

這一條不剝奪你所在地法律給你的強制性權利。如果你所在國家或地區的消費者保護法賦予你不可透過約定排除的權利（例如在本地法院起訴的權利），那些權利仍然有效，本條不影響它們。
